WAIVER OF LIABILITY & INDEMNIFICATION AGREEMENT and Terms and Conditions
I acknowledge and agree to the following terms:
I understand and agree that participating in activities with Dame Errant LLC may involve certain risks and that I am solely responsible for any injury, death, or property damage that may occur during my participation or that of my minor children.
I hereby release Dame Errant LLC, its owners, officers, employees, contractors, directors, agents, and successors from any liability, except for cases of their sole negligence or intentional acts, connected in any way with my participation or my minor children's participation in Dame Errant LLC activities.
I have been made aware of California Proposition 65 warning: Products used at the studio can expose individuals to chemicals, including crystalline silica, which is known to the State of California to cause cancer or birth defects or other reproductive harm.
I understand that Dame Errant LLC may photograph and/or videotape me and/or my minor children during our participation in Dame Errant LLC programs. I hereby give my consent to Dame Errant LLC to use such photographs or videotapes for archival and promotional purposes.
I agree to comply with all rules and regulations set forth by Dame Errant LLC and understand that failure to do so may result in the termination of my participation without any refund.
I certify that I have carefully read and understood the Waiver of Liability, Photography/Videotape Release, and Indemnification Agreement and agree to be bound by its terms and conditions.
Please note, we do not offer refunds. Workshops are non-refundable & non-transferable.
Force Majeure: The Instructor shall not be liable for any failure or delay in the performance of obligations under this Agreement, including the provision of classes, due to circumstances beyond their reasonable control. Such circumstances include, but are not limited to, acts of God, natural disasters, inclimate weather, war, terrorism, government restrictions, pandemics, labor strikes, or other events outside the Instructor's control. In the event of such delays or interruptions, class schedules may be adjusted, and alternative arrangements made where feasible.
Clay takes patience. Pieces take approximately 2-5 weeks to be fired. Shipping can take an additional 2 weeks.
Participants accept the risk that working with clay is and will accept the outcome of their finished piece.
Registration and Attendance:
Minors must be accompanied by a participating adult and all members of the party must register. Age restrictions per the individual workshop must be honored.
To ensure a quality experience for all registered participants, our workshops are designed for those who have signed up in advance. Please note that extra guests are not permitted to attend or observe the workshop unless they have registered themselves. This includes children—our workshops cannot accommodate unregistered minors. We appreciate your cooperation in helping us maintain the integrity and focus of our sessions.
Participants that disrupt the meditative environment will be asked to leave.
Drug and Alcohol Policy Dame Errant Clay is committed to providing a safe, healthy, and productive environment for all guests and staff. The following policy on drugs and alcohol applies, with an exception for sanctioned events:
Prohibition of Alcohol and Drugs: The possession, use, or distribution of alcohol and illegal drugs on studio premises is strictly prohibited, unless alcohol is provided by Dame Errant Clay during official studio-sanctioned events. This includes all areas of the studio, both indoor and outdoor, as well as any adjacent areas under the control of Dame Errant Clay.
Impairment: No person shall operate studio equipment, machinery, or tools if impaired by drugs, alcohol, or other substances. This includes prescription medications that may affect the safe operation of machinery or equipment, and applies even during studio-sanctioned events where alcohol is served.
Legal Medications: Individuals who are taking prescribed or over-the-counter medications are responsible for consulting with their healthcare providers regarding the medication’s effect on their fitness for duty and ability to work safely, and must notify studio management accordingly.
Compliance and Enforcement: Failure to comply with this policy can result in immediate removal from the premises and may also result in further disciplinary action, including but not limited to, the termination of any contracts or agreements with Dame Errant Clay.
Reporting Obligations: Guests, members, and staff are encouraged to report any suspected violations of this policy confidentially to studio management without fear of retaliation.
CODE of CONDUCT:
Dame Errant does not tolerate any form of hurtful language, discrimination, abuse, marginalization, or insulting behavior on the grounds of gender, ethnicity, religion, background, skin color, religious belief, sexuality, gender identity, socioeconomic class, caste, disability, or age. Dame Errant does not accept sexism, racism, colorism, homophobia, biphobia, interphobia, and transphobia or hostility, anti-Semitism, Islamophobia, fascism, age discrimination, ableism, and other and/or intersectional forms of discrimination. Any claywork that includes such will be ritually destroyed, and students may face being banned and will not receive refunds.
In addition, Dame Errant does not tolerate any acts of violence, insults, threats, abuse, or harassment of any verbal, physical, sexual, or other nature towards its visitors, guests, partners, and employees.
Violating the Dame Errant Code of Conduct may result in removal from premises (with NO REFUND), and up to and including a ban from all future classes.
